§1 GENERAL PROVISIONS

  1. These Terms and Conditions set forth the rules for the use of the website available at earlyaccess.fun-crafters.com, including the provision of services by electronic means consisting in enabling Users to subscribe to the players' Database, who will receive early notification about the Operator's new game's premiere and the opportunity to join to this new game together with the right to obtain Welcome package in this game in return for creating an account in this game.
  2. These Terms and Conditions also constitute the terms and conditions referred to in Article 8(1)(1) of the Act of 18 July 2002 on the provision of electronic services and are made available to Users free of charge in a form that allows them to be downloaded, saved and printed via the Website. The Terms and Conditions specify:
    • Rules for the provision of services by electronic means involving subscription to the players Database, who will receive early notification about the Operator's new game's premiere and the opportunity to join to this new game together with the right to obtain Welcome package in this game in return for creating an account in this game.
    • Rules for the use of the Website by Users,
    • Rights and obligations of Users and the Operator,
    • Rules for the protection of Users' personal data.
  3. The Website is operated and owned by: Fun Crafters Ltd. with its registered office at HaSheizaf 4, Ra'anana, Israel. entered into the Register of Companies under number 516791498. The Operator can be contacted via the email address: support@fun-crafters.com.
  4. The organiser of the promotional campaign for players registered in the Players' Database is Operator.

§2 DEFINITIONS

The terms used in these Terms and Conditions (whether capitalized or not) shall have the following meaning:

  • Operator - Fun Crafters Ltd. with its registered office at HaSheizaf 4, Ra'anana, Israel. entered into the Register of Companies under number 516791498.
  • Website - the website operated by the Operator at the address: earlyaccess.fun-crafters.com.
  • User – any natural person, legal person, or organizational unit without legal personality using the Website.
  • Service - a service provided by electronic means by the Administrator to the User via the Website, including a subscription form enabling subscription to the players' Database, who will receive early notification about the Operator's new game's premiere and the opportunity to join to this new game together with the right to obtain Welcome package in this game in return for creating an account in this game.
  • Game – new Game from the Operator, the release date of which will be announced to users by the Operator using the registration form on the Website.
  • Database – means the database maintained by the Operator containing the email addresses of persons who have subscribed via the subscription form.
  • Promotion - upcoming marketing campaign concerning the Game including enabling registered Users to join pre-release version of Game and obtain bonus for players in this game consisting of Welcome package for registered players.
  • Welcome package – bonus in the Game for players registered in Database granted under the terms and conditions described in these Terms and Conditions.

§3 SERVICE PROVIDED BY ELECTRONIC MEANS

  1. The Operator provides Users, free of charge, with a service provided by electronic means in the form of a subscription form to the Database, subsequently enabling the receipt of a notification early notification about the Operator's new game's premiere and the opportunity to join its pre-release version as part of a Promotion.
  2. The subscription form service is made available to the User who enters their email address into the subscription form. The subscription form is made available on the homepage of the Website.
  3. In order to subscribe to the Database of individuals, who will receive notification about the game, the User is required to:
    • Have an active email account,
    • Complete the registration form, providing your email address,
    • Accept the Terms and Conditions,
    • Agree to receive commercial information by electronic means (necessary to send notification of the start of the Promotion).
  4. Upon subscribing, the User shall receive an email message requesting confirmation of the subscription to the Database, along with a link enabling the User to request the removal of their data from the Operator's Database.
  5. At the time of publication of pre-release version of the Game, the User shall be notified of this fact via an email message containing the link to create an account in the Game.
  6. The Agreement for the provision of services by electronic means is concluded at the moment of clicking the button confirming the subscription, labelled: "Submit".
  7. The subscription form service, provided by electronic means, is free of charge.
  8. The Service is provided for an indefinite period. The User may terminate the Service and request the removal of their data from the Database at any time by clicking the unsubscribe link (in the footer of the email message) or by contacting the Operator.
  9. The Operator stipulates that subscription to the Database maintained by the Operator is for informational purposes only, does not constitute the conclusion of an agreement to participate in Promotion nor does it constitute a promise to enter into such an agreement, nor does it guarantee the receipt of Welcome package for players.

§4 TERMS AND CONDITIONS FOR GRANTING WELCOME PACKAGES AS PART OF THE PROMOTION

  1. The Operator, as part of the Promotion which shall commence upon notification by the Operator regarding the Game's version availability, will award Welcome packages for players who meet the conditions specified in section 2 below.
  2. To receive the Welcome Package, the User must meet the following conditions:
    • Subscribe to the Database on the terms set forth in these Terms and Conditions,
    • Confirm the subscription to the Database in accordance with §3 section 4 above,
    • Upon receipt of notification from the Operator regarding pre-release publication of the Game, the User create an account in this game using the email address provided when registering with the Database.
  3. As part of the Welcome Package, upon fulfilling the conditions specified in section 2, the User shall receive a one-time in-game content pack with a value of USD 25.
  4. The Welcome package will be assigned to the User's account in the Game automatically upon activation of the account, subject to prior verification by the Operator of the subscription to the Database.
  5. The Welcome package is non-transferable and may not be exchanged for cash or other cash equivalents.
  6. Each User may only use the Welcome Package once.
  7. The Operator reserves the right to verify the User's identity and to suspend the account in the Game in the event of detecting fraudulent activity (i.e. the creation of multiple accounts by the same person for the purpose of claiming the Package multiple times (so-called "multi-accounts")).
  8. The Promotion shall remain in force until revoked. The Operator shall notify of the termination of the Promotion by means of an announcement published on the Website at least 7 days in advance.

§5 LIABILITY

  1. The User using the Website is obliged to:
    • Use the services provided by electronic means available on the Website in a manner consistent with the law and good morals, as well as in a manner that does not infringe upon the personal rights of the Operator or third parties.
    • Refrain from using the services provided by electronic means to publish advertisements and other commercial information, including the dissemination of unsolicited commercial information.
    • Refrain from publishing or transmitting offensive or unlawful content, as well as content infringing upon the copyrights or image of third parties.
    • Refrain from taking any other actions that could disrupt or hinder the operation of the Website.
  2. The Operator stipulates that it shall not be liable for:
    • interruptions in access to services resulting from necessary technical and administrative activities,
    • disruptions in the operation of the Internet network, Internet supply, and interruptions in access to services caused by force majeure,
    • discontinuation of the provision of services to Users who have committed a breach of these Terms and Conditions,
    • damage caused to third parties as a result of the use by Users of services provided by electronic means in a manner contrary to these Terms and Conditions and generally applicable provisions of law,
    • consequences resulting from the provision by the User of false, incorrect, or incomplete information,
    • consequences of providing the data of third parties without their consent or knowledge.
  3. The User shall bear sole liability for the consequences resulting from the provision of false, incorrect, or incomplete information, or the provision of third-party data without their consent or knowledge.
  4. In the event that the Operator receives official notification regarding the unlawful nature of stored content, where such data was provided to the Operator by the User, and access to such data is disabled, the Operator shall not be liable to the User for any damage resulting from disabling access to such data.
  5. In the event of damage arising in connection with the provision of services by electronic means, each party to the agreement for the provision of services by electronic means, concluded on the basis of these Terms and Conditions, is obliged to remedy the damage suffered by the other party as a result of non-performance or improper performance of obligations arising from the Terms and Conditions, except where such non-performance or improper performance of obligations arising from the Terms and Conditions results from circumstances for which neither party is responsible.

§6 TECHNICAL CONDITIONS AND REQUIREMENTS

  1. The Website is available to all Users of mobile and desktop devices meeting the technical requirements specified below.
  2. Use of the Website is voluntary and free of charge.
  3. For the launch and proper operation of the Website, the cumulative fulfilment of the following conditions is necessary:
    • possession of a terminal device (e.g., computer, tablet, smartphone) with Internet access,
    • possession of an active and updated web browser in the latest stable version,
    • possession of an email address.
  4. The Operator informs that the Website is optimized for the latest versions of popular web browsers, and the use of older software may result in its incorrect operation.
  5. The Operator shall not be liable for the incorrect operation of the Website or the lack of access to the Services resulting from the User's failure to meet the technical requirements set forth above, or from the incompatibility of the User's device with the Website's software.
  6. The Operator reserves that due to the public nature of the Internet, which is also used to connect to the Website and to transfer data, including e-mail, the provision of services by electronic means may involve standard risks, which the User accepts. In order to minimise the risk and increase the level of security, the Operator recommends that Users take measures to protect the end devices they use to browse the Website, including by introducing mechanisms to control access to these devices, installing anti-virus software, updating the operating system, and connecting end devices only to reliable wireless networks.

§7 COMPLAINTS

  1. Complaints regarding the operation of the Website, as well as the Promotion, should be submitted electronically to the email address: support@fun-crafters.com or in writing to the address of the Operator's registered office.
  2. A complaint submission should include: contact details to which the response is to be sent, and the content of the complaint, i.e., a description of the problem and the reason for the complaint.
  3. The time limit for processing the complaint and providing a response is 14 days.
  4. Responses to complaints shall be sent via email, in accordance with the contact details provided by the person submitting the complaint in the complaint submission.

§8 INTELLECTUAL PROPERTY RIGHTS

  1. The User acknowledges that all copyrights (including economic copyrights and related rights), trademark protection rights, rights to logotypes, as well as other intellectual property rights concerning the Website and the content published therein, are the property of the Operator or that the Operator is authorized to use them under appropriate licenses. The use of the Website does not result in the acquisition by the User of any copyrights.
  2. Copying, distributing, sharing, reproducing or creating derivative works and adaptations of the Website or its elements, or placing them on the market, is prohibited.

§9 PERSONAL DATA

  1. The Data controller of User's personal data is Operator set forth in § 1 section 3 of the Terms and Conditions.
  2. Personal data is processed for the purposes and within the scope specified in the Privacy Policy.
  3. Detailed information regarding the processing of personal data, including the User's rights (the right of access, rectification, erasure, restriction of processing, data portability, and the right to object), is contained in the "Privacy Policy" document, made available separately on the Website.

§10 FINAL PROVISIONS

  1. The Terms and Conditions, in their full version, are available for review by Participants at the address: earlyaccess.fun-crafters.com/en/terms-of-service.
  2. The Operator reserves the right to amend these Terms and Conditions for valid reasons, such as:
    • a change in generally applicable provisions of law,
    • a change in the scope or type of Services provided,
    • the introduction of new Services,
    • a change in the Operator's details,
    • the necessity to comply with recommendations, orders, or rulings of public administration authorities or courts.
  3. The Operator shall inform Users of any changes to the Terms and Conditions by publishing an announcement in the form of a banner on the homepage of the Website at least 14 days prior to the entry into force of the changes. In the event of non-acceptance of the new Terms and Conditions, the User may request the removal of their data from the Operator's Database.
  4. To matters not regulated by these Terms and Conditions, generally applicable provisions of law shall apply.
  5. These Terms and Conditions shall enter into force on 1st February 2026.
